Dog Boarding Services Agreement
**PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO SUE DEHART CONSULTING, LLC, OPERATING AS CAMARILLO CANINE AND RELATED PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEE THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT. THIS IS A WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT FOR SERVICES RELATING TO ANY BOARDING, TRAINING OR ANY DAY SCHOOLS.**
These are the terms applicable to dog boarding services and are binding between the dog owner, hereinafter referred to as “Owner” and DeHart Consulting, LLC doing business as Camarillo Canine, hereinafter known as “Camarillo Canine”. The dog to be boarded is hereinafter referred to as “Dog” or “Dogs”:
- **LEGAL OWNER**: Owner affirms that he/she is the legal owner or agent of the owner of Dog described above.
- **HEALTH**: Owner affirms that Dog is in good health, is current on all required vaccinations (Distemper/DHLPP, Rabies, Bordetella, Parvo), is free of fleas, ticks, and lice, and has not been ill with any known contagious viruses in the last 30 days. Owner understands that, while Dog is fully vaccinated, vaccines are not guaranteed and there is a small risk that Dog may contract a contagious disease or illness. Owner agrees that should this occur; Owner is responsible for Dog's care and medical attention. Owner agrees to allow 7 days waiting period after Dog has had their vaccinations to allow the vaccines to reach their full protection potential, and to ensure that Dog has not had any negative reaction to the vaccines. Should Owner allow Dog to stay at Camarillo Canine's facility less than 7 days after vaccination, Owner understands that Dog could be at risk of contracting a contagious virus/disease. Dog’s vaccination records must be provided to Camarillo Canine.
- **DUTY TO DISCLOSE**: Owner agrees to disclose any and all previous or current medical or behavior issues or concerns of Dog so that Camarillo Canine's staff can make a determination of the suitability for boarding. If any information is withheld, especially related to behavior, and it is found out later in the program, Camarillo Canine has the right to terminate boarding immediately with no refund.
- **GROOMING**: Owner agrees to deliver Dog in a condition of good grooming and that Camarillo Canine will endeavor to maintain this state of grooming. If Camarillo Canine decides that Dog is in need of professional grooming while under its care, Owner will be notified and asked to authorize payment for later reimbursement to Camarillo Canine. If Owner declines to authorized the grooming and payment, then Camarillo Canine may, at its sole discretion, return Dog to Owner and terminate boarding immediately with no refund.
- **RIGHT TO REMOVE**: Owner understands that Camarillo Canine reserves the right to permanently remove Dog from its facilities at any time.
- **INCIDENTS**: Owner understands that although all dogs are fully supervised, incidents or injuries may occur from boarding, which include, but are not limited to, escapes, bites, scrapes, scratches, and sprains. In boarding situations, this is typically a very different type of environment compared to their home life and this can be generally stressful for dogs. This can cause dogs to have stress symptoms such as loose stool/diarrhea, vomiting or localized hot spots from chewing. If any of these incidents occur and is noticed by Camarillo Canine staff, we will monitor Dog for up to 24 hours. If symptoms persist longer than 24-hour period or another symptom appears in that period that deems this situation more serious, we will notify Owner and ask which steps to take next, whether to monitor or schedule a vet visit. If we cannot contact Owner, we will call the designated veterinarian for advice.
- **INCIDENTS - MEDICAL ATTENTION**: I allow Camarillo Canine's staff to contact my veterinarian or any other accessible vet clinic as deemed necessary, should any injuries or medical conditions require medical attention. Owner agrees that Owner is solely responsible for any medical expenses required for Dog. Owner understands that Owner may be responsible to pay travel and time for the Camarillo Canine staff member that is transporting Dog to the vet. Travel is based on the government (IRS) reimbursement rate and time based on the Camarillo Canine hourly fee schedule. Owner releases Camarillo Canine from any liability should Dog injure or harm another dog or person in any way and accept complete medical and legal responsibility for Dog's actions.
- **PAYMENT - PROCEDURE**: Owner understands that ALL services provided, and packages sold are non-refundable and not transferrable. Owner agrees to pay for any and all outstanding charges prior to or at time of Dog starting the program. In any circumstance that Camarillo Canine deems a refund necessary; a $200.00 admin fee will be deducted. All programs will expire after 6 months if not used, and no refund will be issued.
- **BOARDING PERIOD**: Camarillo boards dogs at a daily rate and if the departure time is more than two (2) hours later than the arrival time, the last day is considered an additional day.
- **BOARDING -- PROVIDING LIFE ESSENTIALS**: Owner agrees to provide a sufficient amount of life essentials, such as food or medication or any item essentials for Dog to sustain its standard of living. If Owner fails to do so, Owner allows Camarillo Canine to proceed to purchase the essential supplies and accordingly apply associated charges or any reasonable expenses incurred to Owner’s account at the time of purchase and Owner agrees to pay via ACH/Credit Card within 48 hours of invoice.
- **FAILURE TO PICK UP**: In the event that Owner, or Owner’s emergency contact, or any other person Owner has authorized to us in writing does not pick up Dog on the agreed upon departure date and time, Owner hereby authorizes Camarillo Canine to continue to provide boarding and any additional services at Owner’s expense of $150/night/dog. If Dog is deemed abandoned under State laws, or Owner hasn't made arrangements in 4 days of past due pick-up, Camarillo Canine will use its discretion permitted by law to follow the ABANDONED PET PROCEDURE. If this amount isn't paid at the pick-up of said dog, Camarillo Canine has the right to send this bill to a collections agency or pursue in Small Claims Court.
- **IN CONSIDERATION OF ALL THE TERMS OF THIS AGREEMENT**, Owner releases Camarillo Canine, its staff, owners, representatives, and agents from any and all liability which Owner or Dog may suffer, including, but not limited to injury, sickness, damage, or death resulting from participation in training, boarding, or circumstances occurring outside the facility. I also release Camarillo Canine from any liability should Dog injure itself or another dog or person and accept medical and legal responsibility for Dog's actions.
- **PAYMENT**: Full payment is required to confirm your reservation. Reservations are not transferable to another class or another dog. All services and packages sold are non-refundable.
- **RELEASE OF INFORMATION**: Owner agrees to allow Camarillo Canine to discuss history, protocols, family dynamics, and any pertinent information with their veterinarian, appropriate animal professionals, family members, etc. as applicable.
- **ON TIME START/DROP OFF/PICK UP**: Camarillo Canine strives to start and end appointments on time. Being late to any appointments cause delays in scheduling and ends up affecting other clients during the day. Owner agrees to be respectful and punctual for all set appointments, whether it is simply a drop-off, pick-up or a booked session. Safety and a good experience are our goals here. If Owner arrives early for a scheduled appointment, Owner agrees to contact its trainer before entering the facility.
- **CLEANLINESS**: Owner is responsible for the removal of excrement that their pet is responsible for when out in the front areas, or when on field trip sessions.
- **REMOVAL FROM BOARDING**: Camarillo Canine, at its sole discretion, may refuse entry to any dog that is not healthy or is deemed not suitable for the services provided. Camarillo Canine reserves the right to terminate the boarding contract at any time before or during its term if Camarillo Canine determines that a danger exists to the health and safety of the staff, Owner, or Dog, or in the case it is evident Owner is not following the requirements of our program. Should Camarillo Canine or Owner terminate the boarding contract at any time prior to completion, all fees are non-refundable and non-transferable.
- **CANCELLATION POLICY**: Any changes or cancellations must be made within at least 24-hours notice to Camarillo Canine.
- **TERM AND TERMINATION**. The respective duties and obligations of the contracting parties shall be for a period of one year commencing on the date of the execution of this Agreement, and may be terminated by Camarillo Canine giving sixty (60) days written notice to Owner at the address stated below or at an address chosen subsequent to the execution of this Agreement and duly communicated to Camarillo Canine. Owner may terminate this Agreement at will at any time with thirty 30 days written notice to Camarillo Canine.
- **RIGHT TO RECORD**: Video or photos may be published on the Camarillo Canine website or any social media accounts. Owner hereby acknowledges that Owner, Dog, and additional participants may be included in media posted on the Camarillo Canine's website. All video and photos are the property of Camarillo Canine and Owner agrees that any recording is only to be done by Camarillo Canine staff and no video recording shall be permitted by Owner or any attendee, unless written permission is provided by Camarillo Canine.
- **RISK OF PARTICIPATION**: Owner understands that participation in any boarding program is not without risk to Owner, Dog, and additional participants. Owner further understands and indemnifies Camarillo Canine from the risk that Dog, or Owner, may contract an illness during boarding, or on the property during boarding.
- **TRANSPORTATION**: Owner understands that when Dog stays with Camarillo Canine they have the right to transport Dog. This may be to different areas within the location, or to different Camarillo Canine locations. In some cases, dogs may be assigned to a different facility at a different location than Dog's original drop off location. Owner understands that the dog will be safely transported at Camarillo Canine discretion.
- **PROGRAM DETAILS**: The programs at Camarillo Canine are detailed on www.camarillocanine.com and do not include any guarantees or refunds due to the nature of the programs. Extensions or modifications to a program will be at the discretion of Camarillo Canine and will be approved on a case-by-case basis.
- **IN CONSIDERATION OF ALL THE TERMS OF THIS AGREEMENT**, Owner does hereby waive and release Camarillo Canine from any and all liabilities of any nature. Owner agrees to take complete responsibility for the action of Dog, Owner and any additional participants, before, after and during the boarding period. At no time will Camarillo Canine, or its staff, be liable or responsible for the actions of Owner, Dog, or any additional participants. Owner hereby waives and releases Camarillo Canine, all owners and other animals in attendance, and any of the above mentioned employees, owners, and agents from any and all liability of any nature for injury or damage that Owner or Dog may suffer, including specifically, but not without limitation, any injury or damage resulting from the action of any dog, and Owner expressly assumes the risk of any such damage or injury while boarding or while supervising or interacting with a dog while on the grounds or surrounding area thereto. In consideration of this agreement to a boarding program, Owner waives the right from any and all claims or claims by any member of my family or any additional participants as a result of any action by any dog, including Dog. In the case Owner decides to go against this Release of Liability Waiver and take matters to civil court; should judgment be in favor of Camarillo Canine, Owner shall be responsible to pay all costs incurred to Camarillo Canine in the lawsuit, including lawyer fees, witness time/loss of pay, and any other costs that can be proven associated with the case.
- **Venue**, Owner and Camarillo Canine consent to the jurisdiction and venue of an appropriate court located in the County of Ventura, CA, United States of America.
